Terms of Service

Offer:

§ 1 An offer from the GateSet site (owner GateSet Ltd.) relates to fence systems, gate systems, gates, their accessories and any assembly work. Details such as the number of elements in one position, type and description of the yard gate, height, width, drives, accessories, etc. are described in the offer. All our offers are valid for a maximum of 2 days. All offers are non-binding and without guarantee.

Order:

§ 2 The order is placed directly with us (see paragraph offer). After confirmation of purchase and receipt of payment, delivery takes place between 7 and 10 working days. Custom orders can take up to 12 weeks to complete. Completion date is not delivery date. In case of custom-made versions of the comfort variants, unless otherwise requested by the customer, the lock is positioned on the left and the bolt on the right of the manufacturer when viewed from the inside. Please note that the manufacturer of custom-made versions of the comfort variants, unless otherwise specified, produces the division of the palisades, XPS panels and slats according to technical specifications. An exact allocation can be requested by the customer. The manufacturer checks the feasibility and produces this fence according to customer requirements. A change can only be made in the first 2 weeks after the deposit. After that, a change is not possible. The specified dimensions always refer to the clear dimension between the posts.

Terms of payment:

§ 3 Payment methods You have the following payment options:

– Bank Transfer

– PayPal

– Cash on pickup

– Klarna

– Credit Card

With the payment methods bank transfer, transfer via PayPal, Klarna, Credit Card payment is due immediately after conclusion of the contract. After receipt of the purchase price, the items are delivered to the customer (see paragraph Order). If you pay via PayPal by credit card or direct debit, your account will be debited after the conclusion of the contract. In the case of a special order, 50% is due immediately upon conclusion of the contract. The payment of the balance must be made 7 working days before delivery. If the goods have been delivered without the balance being paid, this must be paid no later than 3 days after the invoice has been issued. The assembly costs are to be paid according to the progress of construction and are divided into two partial payments of 50% each. The first installment is due upon completion of the earthwork and foundation work. The final payment of the assembly costs is due upon handover by the fitter or assembly manager. The assembly work must be confirmed in writing by GateSet Ltd. beforehand. Assembly work will be invoiced separately, even if an offer for assembly including the purchased item has been made. If you have chosen the payment method cash on collection (goods that do not represent a special order), the delivery of the purchased item and payment will take place at our address given in the imprint. The goods remain the property of GateSet Ltd. until full payment has been made. The customer does not have a right of retention of the delivered and not fully paid for goods and will be sued for prosecution. GateSet  Ltd. reserves the right to commission a collection agency to deal with the case once the reminder period has expired. 

Delivery:

§ 4.1 Delivery, delivery conditions: The delivery takes place on the dispatch route to the delivery address/kerbside specified by you. The delivery time can be found in the information for the respective product, or see the ordering section. For deliveries of sliding gate systems, 3 men must always be available on site for unloading.

§ 4.2 GateSet Ltd. reserves the right to charge a daily storage fee of £30 for goods that are ready for collection and stored by us and are not accepted by the client after 14 days prior notification.

§ 5 Damage in transit: If an item is delivered to you that shows obvious damage in transit, please complain to the deliverer immediately and let us know. If you do not do this, there will be no consequences for your statutory warranty rights, this only serves to make it easier for us to enforce any claims against the transport company. Small scratches or production defects are not affected.

§ 5.1 GateSet Ltd. accepts no liability for the installation of faulty door systems or parts and reserves the right to exchange wrongly delivered or faulty door systems or parts. Before installing or assembling the door systems or parts, the buyer undertakes to ensure that all parts are complete and have been delivered correctly.

§ 5.2 If assembly work is offered by GateSet Ltd, the work only relates to manual work that does not require approval. For organisational reasons, assembly work must be contractually agreed in advance in writing. The exact work is described separately in the order. It is up to the customer to arrange and organise the responsibility for the manual work before the start of assembly and the placing of the order.

§ 6 Storage of the text of the contract

We save the order data and the text of the contract. You can also view the text of the contract on the website after the contract has been concluded. Your browser’s print function gives you the option of saving the text yourself. You can view the terms and conditions at any time on this page. After completing the order, you will be sent the order data and the terms and conditions including the cancellation policy and the cancellation form by email.

Liability:

§ 7 Liability, We are fully liable for damage resulting from injury to life, limb and/or health. Furthermore, we are liable in the case of intent or gross negligence in the case of fraudulent concealment of a defect or in all other cases regulated by law. In the event of a breach of an essential contractual obligation, liability for slight negligence is limited to the foreseeable, contract-typical damage. (A contractual obligation is essential if it results in such a significant disadvantage for the party concerned that they essentially miss what they should have expected from the contract.) In the event of a breach of minor contractual obligations, liability is limited to intent and gross negligence .

Privacy:

§ 8 Data protection, The client is aware and agrees that his/her personal data necessary for the order processing are stored on data storage.

He/she expressly agrees to the collection, processing and use of his personal data. The buyer has the right to revoke this consent at any time with effect for the future. In this case, the seller undertakes to delete the personal customer master data immediately, unless an order process has not yet been fully processed. The deletion takes place taking into account the restrictions imposed by the tax office.

Warranty:

§ 9 The warranty on all electrical and mechanical components of the product is 2 years (electrical, the first 6 months without proof, after 6 months with proof by the buyer that the defect already existed) and 5 years (mechanical). The manufacturer’s warranty for rust resistance on hot-dip galvanised private and industrial systems is 2 years, on hot-dip galvanised and powder-coated private systems is 5 years. The operator is responsible for the safe operation of the electric gate systems! In order to ensure this, tests and maintenance must be carried out by an expert at regular intervals (at least once a year). If the specified maintenance intervals are not observed, the operator will no longer have any warranty claims against the specialist dealer or manufacturer. In the event of any complaints or If the customer has doubts about the quality, an expert for steel, metalworking and forging technology can be appointed at his expense. If necessary, he will check the quality standards and permitted tolerances. Our manufacturers of motor drives work with the highest quality standards and seals of the quality certificate ISO 9001. GateSet Ltd assures that the gate systems we sell meet European standards. When ordering different fence systems from different manufacturers, mix fence systems from series A to F, or sets with gates and steel posts, there may be colour deviations in the RAL coating of the individual parts – the colours do not match 100%. If necessary, he will check the quality standards and permitted tolerances. 

Maintenance:

§ 9.1 MAINTENANCE OF THE PAINT-COATED FENCE SYSTEM OF COMPANY GateSet Ltd.

Every fence system should be regularly checked and maintained by the owner. The fence should be checked for the presence of rust spots, scratches, splinters, mechanical damage and white efflorescence. Rust spots can occur in places of water accumulation, and especially at the junctions of two elements (seams), at the place of binding the crosspiece with the clamp or connector (this place is exposed for damage to the outer layer during assembly). Scratches, breaks, chipped paint and places where the lower parts of the fence system come into contact with, for example, grass or lying snow. In the above cases, the rust area should be cleaned down to the raw material. The following tools should be used for cleaning: Sanding machine with the appropriate attachment, wire brush, spatula or sandpaper with the appropriate paper size. These places should be carefully cleaned and dried, as a missed contamination can cause rust spots to return under the surface of the applied paint. Chemical substances such as Fosol should be used for very dirty surfaces. You should also think about degreasing the surface before painting and drying it properly. In the places where the elements of the fence system work (hinges, bolts of the automatic system), the working surfaces wear out. It is a natural process that occurs with use. Corrosion can occur as a result of wear of the layer in combination with weather conditions. In order to reduce the occurrence of the above event, e.g. graphite lubricant should be used at the point of contact of the working elements of the fence system. This also applies to the elements connected to the automation of the gates. White efflorescence occurs as a result of the action of chemical substances. They are caused by salty or alkaline environment (close distance from reservoirs with salt water and in areas where chemical substances are used, including road salt solutions, which have a harmful effect on paint). To remove this defect, the same steps as for removing the rust should be used. In special cases such as flooding, where the fence coating has been in contact with liquid for a long period of time, the fence system should be dismantled, dried and the substances that got inside the frames, crosspieces and bars should be removed. The entire fence system should be carefully dried and reinstalled. If maintenance is necessary, follow the instructions above.

.Change, termination, cancellation of an order:

§ 10.1 Changes according to customer requirements, in the case of a custom-made product after the order has been placed (except for changes due to an oversize), will be charged with a processing fee of £150.00 (incl. VAT) and will be invoiced separately from GateSet.co.uk are not standard goods, there is no right to withdraw from the contract. All ordered goods are specially made to measure, colour, running direction and equipment according to “customer request” and therefore do not fit into any other property! If the goods are not accepted, a contractual penalty of at least 50% of the agreed value of the goods will be stipulated. A processing fee of £15.00 (incl. VAT) will be charged for refunds due to overpayment or incorrect transfer.

§ 10.2 GateSet Ltd reserves the right to terminate an assembly order if the client is more than 2 weeks in arrears with payment. All services, work and deliveries that have been made are unaffected by the termination and must be paid for by the customer.

§ 10.3 GateSet Ltd reserves the right to reorder and redeliver wrongly delivered or faulty door systems (including special orders) as part of the reparation.

§ 11 A cancellation period of one month applies to online transactions. As a consumer, you have the right of withdrawal in accordance with the following instructions: Instructions on withdrawal/right of withdrawal: You have the right to withdraw from this contract within one month without giving a reason. The cancellation period is one month from the day on which you or a third party named by you who is not the carrier took possession of the last goods. The buyer bears the return costs. The reverse transaction takes place within 7 working days after receipt and inspection of the goods. If the customer paid via PayPal, the buyer protection can only be activated 7 working days after the goods have arrived at the seller. If buyer protection is activated beforehand, the seller reserves the right to take action against it.

See judgment: (BGH AZ: VIII ZR 83/16 and VIII ZR 213/16t). A seller is therefore entitled to sue for a payment in court, even if PayPal buyer protection previously enabled the reverse transaction.

by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. You can use the attached sample revocation form for this, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send the notification of your exercise of the right of cancellation before the cancellation period has expired. Consequences of cancellation: If you cancel this contract, we will send you all payments that we have received from you, including delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us), to be repaid immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. We can refuse repayment until we have received the goods back or until you have provided proof that you have sent the goods back, whichever is earlier. You have the goods immediately and in any case within fourteen days at the latest to be returned to us or handed over to us from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to the handling other than what is necessary to establish the nature, characteristics and functioning of the goods. Exclusion of the right of withdrawal The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer, model withdrawal form. If you want to revoke the contract, please fill out this form and send it back to us:

§ 12 Final Provisions

UK law shall apply exclusively to these General Terms and Conditions and to the contract concluded in each case, excluding the UN sales law, provided the buyer is not a consumer. If the buyer is a registered trader, a legal entity under public law or a special public fund, all disputes which result from or in connection with the present contract, the district court of London is agreed as the place of jurisdiction. Should one or more clauses of these terms and conditions be wholly or partially ineffective, this shall not affect the validity of the remaining provisions.
